Development of a QMS and Related Implementing Procedures for the Maritime Administrations of IPA and ENP Countries

GENERAL INFORMATION

The European Maritime Safety Agency (EMSA) was established under Regulation (EC) No 1406/2002 of the European Parliament and of the Council1 for the purpose of ensuring a high, uniform and effective level of maritime safety, maritime security, prevention of, and response to, pollution caused by ships as well as response to marine pollution caused by oil and gas installations. Among the Agency’s core tasks is the provision of technical assistance upon the request of the European Commission (EC) to States applying for accession to the Union (under the “Instrument for Pre-Accession assistance“- IPA) and, where applicable, to European Neighbourhood Policy (ENP) partner countries.

The technical assistance predominately aims at building up the necessary national capacity for the implementation of relevant legal acts of the European Union (EU) as well as international maritime conventions adopted either by the International Maritime Organisation (IMO) or the International Labour Organisation (ILO).

In order to further strengthen the national capacity of beneficiary States, both within the context of IPA and ENP, for the appropriate implementation and enforcement of EU and international maritime legislation, EMSA has included in its portfolio of activities, the development and implementation of a Quality Management System (QMS) to enhance maritime administration’s activities and performance. The Contractor is requested to develop a QMS related to Flag, Coastal and Port State activities falling within the remit of a MARAD taking into account, as a minimum, the relevant provisions of the IMO Resolution A. 1070 (28) (Code for Implementation of IMO Instruments hereinafter III Code) and, as applicable, of the Directive 2009/21/EC of the European Parliament and of the Council of 23 April 2009 on compliance with flag State requirements (hereinafter Directive on FS) in its latest version or its future amendments.

This FWC would entail the following services:

a) Flag State related activities of a MARAD:

i. Develop a QMS and related procedures for the Flag State related activities falling within the remit of a MARAD in English, taking into consideration the relevant provisions of the III Code in compliance with “ISO 9001:2015 Quality Management Systems- requirements”.

ii. Support the beneficiary in the implementation of the QMS and related procedures until it is certified in accordance with the applicable international quality standards and as foreseen by the Directive on FS in its latest version or its future amendments.

b) Port and Coastal State activities

i. Supplement the QMS developed under a) with related procedures in English for the Coastal and Port State activities falling within the remit of a MARAD, taking into consideration the relevant provisions of the III Code and in compliance with “ISO 9001:2015 Quality Management Systems – requirements”;

ii. Support the beneficiary in the implementation of the QMS and related procedures for the Flag State activities procedures until it is certified in accordance with the applicable international quality standards and as foreseen by the Directive on FS in its latest version or its future amendments, and upon request of the beneficiary for the Coastal and Port State activities.
